These Terms and Conditions ("Terms") govern your access to and use of faceswitch.cc (the "Site") and any services, features, or content provided through it (collectively, the "Services"). 1. Acceptance of Terms

2. Use of the Services

2.1 Eligibility

Create or upload content depicting a minor, or sexually explicit content of any person.
Present a generated image or video as an authentic, unaltered photograph or recording of a real event.
Attempt to reverse-engineer, hack, or interfere with the Site’s functionality.

3. User-Generated Content

3.1 Ownership

You retain ownership of any content (e.g., images, files) you upload to the Site ("User Content"). However, by uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and display it as necessary to provide the Services.

3.2 Responsibility

You are solely responsible for the User Content you upload. You represent and warrant that:

You have all necessary rights, permissions, and consents to upload and use the User Content.
You have obtained the consent of every identifiable person whose face or likeness appears in the User Content, including any face you use as a source and any face you replace.
Every person depicted in the User Content is 18 years of age or older.
The User Content does not violate any laws or third-party rights (e.g., privacy, publicity, copyright).

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

4. Intellectual Property

4.1 Our Content

All content on the Site (excluding User Content), including text, graphics, software, and designs, is owned by or licensed to FaceSwitch and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from our content without prior written consent.

4.2 Trademarks

"FaceSwitch" and associated logos are our trademarks. You may not use them without permission.

5. Payments and Subscriptions

5.1 Fees

Certain Services may require payment. All fees are listed on the Site and are non-refundable unless otherwise stated.

5.2 Payment Processing

Payments are processed through third-party providers. You agree to provide accurate billing information and authorize us to charge your payment method.

5.3 Subscription Cancellation

If applicable, you may cancel a subscription at any time, but no refunds will be issued for partial billing periods.

6. Disclaimers

6.1 "As Is" Basis

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.2 No Guarantee

We do not guarantee that the Services will be uninterrupted, error-free, or secure, or that any results from the Services will meet your expectations.

7. Limitation of Liability

To the fullest extent permitted by law, FaceSwitch and its affiliates, officers, or employees will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site, even if advised of the possibility of such damages. Our total liability will not exceed the amount you paid us, if any, in the preceding 12 months.

8. Termination

We may suspend or terminate your access to the Site at our sole discretion, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Services will cease immediately.

The Services generate synthetic media: the output is an artificial image or video, not a photograph or recording of a real event. You may only swap a face when you have the informed consent of the person whose face you use and of the person whose face you replace. You are solely responsible for obtaining and, where required by law, documenting that consent.

9.2 Prohibited Uses

You may not use the Services to create content that impersonates a real person for the purpose of deception, fraud, or harassment; that depicts a minor; that is sexually explicit; or that is presented as an authentic record of something that did not happen. Some jurisdictions further restrict synthetic depictions of real people, including in electoral, commercial, and intimate-imagery contexts, and you are responsible for complying with the law that applies to you.

9.3 Enforcement

We may remove content, suspend accounts, and cooperate with law enforcement where we believe these requirements have been violated. If you believe your likeness has been used on the Site without your consent, contact us and we will review the report.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
